SECTION 1. Introduction
Welcome to SelectYourFX ("SYFX," "we," "our," or "us").
These Terms of Service and Privacy and Cookies Policy govern your access to and use of the SelectYourFX website, Marketplace, and related services, including the primary website located at selectyourfx.com and Marketplace sites operated on behalf of participating educational institutions (collectively, the "Services").
By accessing or using the Services, you agree to these Terms.
SECTION 2. Nature of the Services
SelectYourFX provides a marketplace and informational platform that enables students and other payers to compare international payment options offered by educational institutions and their approved payment providers.
SelectYourFX is not a bank, financial institution, payment processor, money transmitter, foreign exchange dealer, escrow provider, custodian of funds, or party to any payment transaction between a user and a payment provider.
SelectYourFX does not receive, hold, transfer, convert, settle, or process payments. All payment transactions are initiated, executed, and completed directly between the user and the selected payment provider.
SelectYourFX assumes no responsibility for the availability, execution, settlement, processing, outcome, or performance of any payment transaction or related service provided by a third party.
SECTION 3. Relationship with Participating Institutions
Participating institutions authorize SelectYourFX to maintain and present payment-provider information on their behalf.
In that capacity, SelectYourFX may collect, organize, display, update, and maintain information regarding approved payment providers, payment methods, countries served, pricing characteristics, operational features, and related content.
Institutions remain responsible for determining which payment providers may be presented to their students.
SECTION 4. Marketplace Information
Information displayed through the Marketplace is maintained by SelectYourFX on behalf of participating institutions and may be derived from participating institutions, participating vendors, publicly available vendor materials, information obtained through the SYFX Verified program, direct review of vendor offerings, and other sources believed to be reliable.
SelectYourFX makes reasonable efforts to maintain accurate and current information. However, exchange rates, fees, payment methods, processing times, country availability, and other payment-related information may change without notice.
Users should independently review the terms, pricing, and disclosures provided by the selected payment provider before initiating a transaction.
SECTION 5. Marketplace Designations and Verification Status
Certain payment providers may be identified within the Services as "SYFX Verified."
The SYFX Verified designation indicates that a provider participates in SelectYourFX's verification program and collaborates in maintaining the accuracy, completeness, and timeliness of information presented through the Marketplace.
Verification may include review of information such as supported countries, available payment methods, pricing methodologies, operational features, service availability, and other payment-related information.
The SYFX Verified designation does not constitute an endorsement, recommendation, guarantee, or representation regarding any provider or its services.
Providers that are not designated as SYFX Verified may nevertheless be approved by a participating institution and may appear within the Marketplace.
The presence, absence, order, placement, designation, or presentation of any provider within the Marketplace should not be interpreted as a recommendation or representation regarding that provider's services.
Users remain solely responsible for evaluating and selecting their preferred payment provider.
SECTION 6. No Financial Advice
The Services are provided for informational and comparison purposes only.
Nothing contained within the Services constitutes financial, legal, tax, investment, or professional advice.

SECTION 7. Third-Party Providers
The Services contain links to third-party payment providers and related services.
When a user selects a payment provider, the user leaves the SelectYourFX environment and interacts directly with that provider.
SelectYourFX is not responsible for the products, services, pricing, exchange rates, disclosures, privacy practices, security practices, availability, performance, or actions of any third party.
Any agreement entered into between a user and a payment provider is solely between those parties.

All content, design elements, trademarks, logos, software, graphics, text, and Marketplace materials made available through the Services are owned by SelectYourFX, participating institutions, participating vendors, or their respective licensors.
All third-party trademarks remain the property of their respective owners.
Nothing in these Terms grants ownership rights to users.
SECTION 10. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, SelectYourFX disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
SelectYourFX does not guarantee that the Services will be uninterrupted, error-free, or free of inaccuracies.
SECTION 11. Limitation of Liability
To the fullest extent permitted by law, SelectYourFX shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the Services.
SelectYourFX shall not be liable for losses arising from payment-provider selection, foreign exchange rates, payment processing, transaction delays, failed transactions, payment-provider actions, or reliance on Marketplace information.
If liability is imposed notwithstanding the foregoing, SelectYourFX's aggregate liability shall not exceed one hundred dollars ($100).
SECTION 12. Indemnification
Users agree to indemnify and hold harmless SelectYourFX and its officers, directors, members, employees, and representatives from claims, liabilities, damages, losses, and expenses arising from their use of the Services or violation of these Terms.

SelectYourFX is designed to operate without collecting personally identifiable student information.
SelectYourFX does not request, collect, receive, store, or process:

We collect limited website and Marketplace usage information to understand how the Services are used and to improve functionality.

SelectYourFX does not use analytics information to identify individual users and does not combine analytics information with personal identifiers because personal identifiers are not collected through the Services.

The Services may use cookies and similar technologies to support website functionality, maintain performance, understand usage patterns, and improve the user experience.
Current analytics technologies may include Google Analytics or similar tools.
These technologies help us understand aggregate Marketplace activity, identify areas for improvement, measure engagement with Marketplace features, and evaluate overall platform effectiveness.
The Services do not use cookies or similar technologies to collect payment credentials, student identification numbers, account passwords, or other personally identifiable student information.
The Services use cookies and similar technologies as described in this Policy. Users may manage cookie preferences through their browser settings. Disabling certain cookies may affect the functionality or performance of portions of the Services.
SECTION 16. Information Sharing
SelectYourFX does not sell personal information.
Because SelectYourFX does not collect personally identifiable student information through the Marketplace, there is generally no personal information to sell, rent, or disclose.
We may share aggregated, anonymized, or statistical information that cannot reasonably identify an individual with participating institutions, participating vendors, service providers, or other parties for purposes including Marketplace reporting, analytics, platform administration, operational improvement, research, and development of the Services.
SECTION 17. Data Security
We employ reasonable administrative, technical, and organizational measures designed to protect the Services and related information.
No internet-based system can be guaranteed to be completely secure.
SECTION 18. Children's Privacy
The Services are intended for individuals seeking to make or facilitate educational payments.
The Services are not directed toward children under thirteen years of age.
SECTION 19. Changes to These Terms
SelectYourFX may update these Terms from time to time.
Updated versions will be posted on the Services with a revised effective date.
Continued use of the Services following publication of updated Terms constitutes acceptance of the revised Terms.
SECTION 20. Force Majeure
SelectYourFX shall not be liable for any delay, interruption, or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, internet or telecommunications failures, cyberattacks, utility interruptions, governmental actions, labor disputes, third-party service disruptions, or similar events.
SECTION 21. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
SECTION 22. Entire Agreement
These Terms constitute the entire agreement between SelectYourFX and users of the Services regarding the subject matter addressed herein and supersede any prior or contemporaneous understandings, communications, or agreements relating to such subject matter.
SECTION 23. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict-of-law principles.
Any dispute arising from or relating to the Services shall be brought exclusively in the state or federal courts located in Michigan.
